SkinAura Image & Scan Authenticity  Consent Policy

This Image & Scan Authenticity + Consent Policy (“Policy”) governs all photos, videos, facial scans, progress photos, screenshots, and other visual materials (collectively, “Content”) uploaded or shared through the SkinAura platform, including SkinAura PRO (the “Platform”).

By uploading or sharing Content, or by clicking “I Agree” or “I Understand,” you agree to this Policy and the SkinAura Terms of Service.

1) Private Platform and Access Controls

SkinAura is a private platform. Content is not publicly displayed. Content is accessible only to:

• the account holder who uploaded it, and

• any authorized parties the account holder explicitly invites or connects (for example, a client and their selected skincare professional), and

• SkinAura personnel only as needed for support, safety, fraud prevention, legal compliance, or security operations.

2) Ownership, Consent, and Rights You Must Have

You represent and warrant that:

A. Ownership / Authorization

• You are the sole creator of the Content or you have legal rights and authorization to upload and use it on SkinAura.

B. Consent from Identifiable People

• You have obtained express permission from every identifiable person appearing in the Content, granting you the right to upload and share their likeness within SkinAura.

C. Professional Uploads (Client Content)
If you are a skincare professional uploading client Content, you represent and warrant that you have the client’s written authorization permitting upload, analysis, storage, and viewing within the Platform by the client and authorized parties.

D. No Rights Violations

• Your Content does not infringe or violate privacy rights, publicity rights, copyrights, trademarks, confidentiality obligations, or any other legal rights.

You may not upload Content that:

• was created by another person, brand, or entity without authorization;

• depicts anyone who did not provide informed consent to appear;

• was obtained from stock sources, third-party platforms, or AI tools without the proper license/rights;

• has been manipulated to misrepresent ownership, services performed, or results.

3) Authenticity and No Misleading Results

You may not upload or share Content that is intended to mislead, including:

• “before/after” images that are not your own work or not your client’s authentic progress;

• edits, filters, lighting tricks, or retouching that materially distort results or skin condition when presented as real progress;

• AI-generated, synthetic, or deepfake media presented as authentic results.

Permitted adjustments are limited to non-deceptive edits (for example, cropping, minor brightness correction, or redacting personal identifiers) as long as they do not misrepresent results.

4) Prohibited Content

You may not upload or share any Content that:

• contains pornographic, sexually explicit, or sexually suggestive material;

• depicts minors in any sexualized or exploitative manner;

• contains violence, hate speech, harassment, or discriminatory content;

• includes unnecessary private or confidential information (for example, government IDs, full home addresses, financial account details);

• includes medical records or sensitive information you are not authorized to share;

• impersonates someone else or is intended to deceive.

5) Limited License to Host and Process Content

You grant SkinAura a limited, non-exclusive license to host, store, back up, process, and display your Content only to operate the Platform and provide the services you request (including analysis and tracking features you enable). SkinAura does not claim ownership of your Content.

6) Enforcement

SkinAura may remove, restrict, disable, or permanently delete Content or accounts that violate this Policy, the Terms of Service, or applicable law, with or without notice where permitted.

7) Reporting Violations

8) Responsibility and Indemnification

You are solely responsible for the Content you upload. You agree to defend, indemnify, and hold harmless SkinAura and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from your Content, including claims related to consent, privacy/publicity rights, or intellectual property.
